Construction enterprise qualification renewal for 22 months transition period

According to the "Construction Enterprise Qualification Management Regulations" implemented on March 1 and the Provincial Construction and Construction Department "Construction Enterprise Qualification Management Regulations and Qualification Standards Implementation Opinions", the new regulations for construction industry enterprise qualification management set up a 22-month transition During the transition period, enterprises that have obtained the qualifications of construction enterprises according to the original standards can still hold the original qualification contracting project.
Regarding the "transition period" issue, the above implementation opinions clearly stated that the implementation date of the management regulations (March 1, 2015) to December 31, 2016 is a transition period. Enterprises that have obtained the qualifications of construction enterprises according to the original standards shall renew the new construction enterprise qualification certificates in accordance with the relevant requirements before December 31, 2016.
If the enterprise assets, key personnel, and technical equipment meet the requirements of relevant standards, the qualification licensing authority shall issue a new version of the construction enterprise qualification certificate, and the certificate shall be valid for 5 years. From January 1, 2017, the old construction enterprise qualification certificate will be invalid. If the enterprise assets, key personnel and technical equipment do not meet the requirements of the "Standard", the corresponding qualifications shall not be approved for renewal. The enterprise may propose the same category of qualifications lower than the original qualification level within 3 months after the results of the renewal of the certificate are announced. The application has not been submitted for more than 3 months, and the application is from the lowest level qualification.
The implementation opinion also pointed out that enterprises should submit all construction enterprise qualification certification applications at one time in accordance with the “Regulations” licensing procedures, and submit corresponding materials as required. Enterprises can only choose up to 5 categories of professional contracting qualifications, and more than 5 categories of other professional contracting qualifications apply according to the qualification requirements. Enterprises that have obtained the qualifications of construction enterprises according to the original standards, apply for qualification upgrade (including the first-class upgrade), and the qualifications increase, all the qualifications of construction enterprises should apply for qualification renewal at the same time.
During the transition period, enterprises that have obtained the qualifications of construction enterprises according to the original standards shall, in principle, undertake the projects in accordance with the relevant qualification categories and grades of contracted projects.
In addition, the implementation opinion proposes that after the implementation of the new regulations, the competent departments of housing and urban construction at all levels and other relevant departments shall establish credit files for construction enterprises engaged in construction activities, formulate dynamic supervision measures, and implement differentiated management in accordance with the integrity of enterprises. Use information technology to implement supervision and management of construction enterprises.
For enterprises that have violated laws and regulations, the competent department of housing and urban-rural construction at or above the county level shall investigate and deal with the illegal facts, punishment results or handling suggestions, and report them to the Ministry of Housing and Urban-Rural Development at the same time. It is credited to the credit file of the construction industry and published in the national construction market supervision and integrity platform.
